FetchTech — Terms of Service

These Terms of Service ("Terms") govern your access to and use of fetchtech.com (the "Site") and any purchases made through it (collectively, the "Service"), operated by FetchTech ("we," "us," or "our"). By accessing or using the Site, placing an order, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use this Site. By using the Site, you represent that you meet these requirements.

2. Products and Pricing We make reasonable efforts to display product descriptions, images, and pricing accurately. However, we do not warrant that product descriptions, images, pricing, or other content on the Site are accurate, complete, current, or error-free.

• We reserve the right to correct any pricing or description errors, even after an order has been placed.
• We reserve the right to limit quantities, refuse, or cancel any order at our discretion, including in cases of suspected fraud or error.
• Prices are subject to change at any time without notice.

3. Orders and Payment When you place an order, you are making an offer to purchase the product(s) at the listed price. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

Payment must be received in full before an order is processed and shipped. You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided.

4. Shipping Shipping times and costs vary depending on the product, supplier, and destination, and are provided as estimates only. We are not responsible for delays caused by third-party carriers, customs, or other circumstances outside our reasonable control.

Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier.

5. Returns and Refunds If for any reason you are not satisfied with your purchase, you may return eligible item(s) within 10 days of receiving your order.

The following items are not eligible for return:

• Monogrammed or personalized items
• Special-order items
• Items damaged through normal wear and tear

The customer is responsible for return shipping costs. Refunds will be issued to the original payment method once the returned item is received and inspected. For full details, please refer to our Return & Refund Policy.

6. Intellectual Property All content on the Site, including text, graphics, logos, images, and software, is the property of FetchTech or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

7. User Conduct You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the Site, its systems, or related networks
• Interfere with or disrupt the Site's operation or security features
• Submit false, misleading, or fraudulent information, including in connection with an order or return request
• Use any automated system (bots, scrapers, etc.) to access the Site without our prior written permission

8. Third-Party Suppliers and Links Some products sold through the Site are fulfilled by third-party suppliers. While we work to ensure product quality and accurate listings, we do not manufacture all products sold and are not liable for defects, delays, or issues arising solely from a third-party supplier's actions, except as expressly stated in our Return & Refund Policy.

The Site may also contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any linked third-party sites.

9. Disclaimer of Warranties THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, FETCHTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SITE OR PURCHASE OF ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification You agree to indemnify and hold harmless FetchTech, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

13. Arbitration Agreement Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased through the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

• The arbitration shall be administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable rules in effect at the time the arbitration is initiated.
• The arbitration shall take place in California, or another mutually agreed location, and shall be conducted in English.
• YOU AND FETCHTECH EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
• Each party shall bear its own attorney's fees and costs, except as otherwise required by applicable law or the arbitration provider's rules.

If any part of this arbitration agreement is found to be unenforceable, the remainder shall remain in full force and effect, and the unenforceable provision shall be severed.

14. Changes to These Terms We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

15. Severability If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
